Terms of use
1. Operator and scope of the service
Sigmoney is a service for managing and overviewing personal finances, available through a mobile app and a web app at app.sigmoney.com.
The service is operated by Hugo Hudačin, Via Sent 2, CH-7500 St. Moritz. Contact: kontakt@sigmoney.com.
A contract on the use of Sigmoney is formed at the moment the user expressly confirms agreement to these Terms of use.
The Privacy policy is not part of the contractual consent; it informs the user how Sigmoney processes personal data.
Sigmoney is not a service specially intended for children. Under the law of the country where they live, the user must have the capacity to use the service and to enter into these Terms. If the user is a minor or does not have full legal capacity, they may use Sigmoney only with the consent or assistance of a parent or legal guardian, where the applicable law requires it.
If we learn that an account is used by a person without the necessary legal capacity or the necessary consent, we may ask for appropriate confirmation, restrict the account or delete it.
2. What Sigmoney is – and is not
Sigmoney is a tool for recording, organising, analysing and displaying the user's financial data.
Sigmoney is not a bank, broker, investment adviser, asset manager, lender or payment service provider. Sigmoney does not hold users' funds, does not send money and does not carry out payment transactions or investment orders.
The information shown in Sigmoney is not financial, investment, tax, accounting or legal advice and is not an offer, invitation or recommendation to buy or sell a financial instrument.
The user remains solely responsible for their own financial and investment decisions.
3. Account and security
The user is responsible for the accuracy of their account data and for protecting their login details, password, PIN code and the devices through which they access Sigmoney.
The user must not let an unauthorised person use their account. If they suspect unauthorised access, they should change their login details without delay and contact us.
4. Uploading and processing financial data
Sigmoney may allow data to be entered manually or taken from documents, bank statements, photos, PDF, CSV or other supported files.
Some documents may be processed by automated systems, including OCR, categorisation algorithms or artificial intelligence systems.
Automated processing can make mistakes. The user is therefore obliged to check the data against the original document, bank, broker or another trustworthy source before an important financial decision.
The user declares that they have the right to put the data and documents into Sigmoney and that using them does not infringe third-party rights.
Showing a bank, broker or other financial institution in Sigmoney’s list does not mean that Sigmoney guarantees compatibility with all account types, products or statement formats of that institution. Document formats may change and some documents may not be processed correctly.
5. Rights to user data
The operator does not claim ownership of the content, data or documents that the user puts into Sigmoney. The user keeps all rights they have to this data or documents.
The data and documents that the user puts into Sigmoney remain the user's data.
The user grants the operator a non-exclusive, royalty-free permission to store, technically process, convert, analyse and display this data solely to the extent necessary to provide, secure and operate Sigmoney, to fulfil the user's requests and to comply with legal obligations.
Details of personal data processing are in the Privacy policy.
6. Accuracy of data
Sigmoney may display information obtained from the user, from uploaded documents or from third-party services.
This data may be incomplete, delayed, wrongly interpreted or erroneous. For example, it may involve a wrong amount, currency, date, category, balance, investment price or exchange rate.
Prices of securities and cryptocurrencies, exchange rates and other market data may be delayed or indicative and may not correspond to the price at which an asset can actually be bought or sold at that moment.
Sigmoney does not guarantee that all displayed data is complete, accurate or up to date.
7. Estimates, financial goals and projections
Calculations of the future value of assets, savings, debts, recurring payments, budgets or other future developments are only informative mathematical estimates based on the available inputs and assumptions.
They are not a guarantee or a prediction of future results.
Past performance does not guarantee future results. The value of investments can go up as well as down, and the user may lose part or all of the amount invested.
8. Third-party services
Sigmoney may use third-party services for hosting, databases, document processing, OCR, artificial intelligence, market data, analytics, authentication or other technical functions.
We do not always have control over the availability or correctness of a third-party service.
The names, logos and trademarks of banks, brokers, exchanges, crypto services and other third parties belong to their respective owners. Showing them in Sigmoney does not mean partnership, sponsorship, endorsement or an official connection with Sigmoney unless we say so explicitly.
9. Permitted use
The user gets a limited, non-exclusive, non-transferable and revocable right to use Sigmoney for their personal purposes in accordance with these Terms.
Without our consent, and except where the law expressly allows it, the user must not copy or distribute protected parts of the app; modify, decompile or reverse engineer the software; bypass security or technical restrictions; use bots, scraping or automated tools to collect data in bulk; access non-public APIs or systems; attack, test or overload the infrastructure without permission; use Sigmoney for fraudulent or other unlawful activity; or use protected code, graphics, texts or other protected parts of Sigmoney to create an unauthorised copy of the service.
10. Intellectual property and the Sigmoney brand
Except for user data, open-source components and third-party content or rights, the rights to the Sigmoney brand, its logo, original software, source code, graphics, design, texts and other original content belong to the operator or its licensors.
Using Sigmoney does not transfer to the user any ownership or other rights to these elements.
Without prior written consent, the Sigmoney name or logo must not be used in a way that may suggest partnership, approval or a connection with Sigmoney.
11. Availability of the service
We strive to ensure reliable operation of Sigmoney, but we cannot guarantee uninterrupted or error-free availability.
The service may be temporarily unavailable, for example because of maintenance, a technical fault, a security incident or an outage of a third-party service.
We protect data with reasonable technical and organisational measures, but we cannot guarantee that loss or a security incident is absolutely impossible. The user can use the available export and backup functions.
12. Changes to features and paid services
Sigmoney may keep developing. We may add, change or end some features.
If we offer paid features or a subscription in future, their price and the related terms will be shown to the user before purchase. Purchases made through the App Store or another distribution store may also be subject to that store's rules.
13. Suspension and deletion of the account
The user can delete their account using the function available in Sigmoney.
We may temporarily restrict or suspend an account where reasonably necessary to protect the security of the service or its users, where fraud or abuse is suspected, in case of serious or repeated breach of these Terms, or where the law requires it. Where reasonably possible, we will inform the user of such a step.
Deletion of the account and personal data is carried out according to the Privacy policy and applicable law. Some data may be kept temporarily in backups or to the extent required by law.
14. Limitation of liability
To the maximum extent permitted by applicable law, the operator is not liable for damage or loss arising from inaccurate, incomplete, delayed or wrongly processed data; wrong automatic categorisation of a transaction; an estimate or projection; a user's decision based on data from Sigmoney; temporary unavailability of the service; or a failure of a third-party service that the operator could not reasonably influence.
Sigmoney does not replace the official records of a bank, broker, tax adviser, accountant or other professional.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, in particular liability for intent or gross negligence, or mandatory consumer rights.
15. Privacy
The processing of personal data is governed by the Privacy policy, which explains in particular what data we process, for what purposes, to whom we may disclose it, how long we keep it and what rights the user has. Privacy policy (GDPR) ›
16. Changes to the Terms
We may change these Terms, in particular in case of a change of the service, technology or legal requirements.
We will inform users of a significant change in a reasonable way in advance. If applicable law requires the user's new consent, we will ask for it before further use of the affected service.
17. Governing law and consumer rights
These Terms are governed by Swiss law.
This does not affect the mandatory consumer rights under the law of the country of the consumer's habitual residence, nor rules that give the consumer the right to bring a claim before the competent court where they live.
In other cases the courts at the operator's seat are competent.
18. Severability
If any provision of these Terms proves invalid or unenforceable, this does not affect the validity of the other provisions.
The operator's failure to exercise a right does not mean waiving that right.
